Welcome to ResQ Pet. These Terms of Service ("Terms") govern your use of our QR code pet recovery service, website, and SMS notifications. By accessing or using our service, you agree to be bound by these Terms.

1. Agreement to Terms

By creating an account or using ResQ Pet services, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you may not use our service.

You must be at least 18 years old to create an account
Users ages 13-17 may use the service with parental or guardian consent
Our service is available only to residents of the United States

2. Description of Service

ResQ Pet provides a QR code-based pet identification and recovery service that includes:

QR code tags that link to your pet's profile when scanned
Instant SMS and email notifications when your pet's tag is scanned
A web dashboard to manage your pet profiles and emergency contact information
Emergency contact notification system to alert designated contacts

3. Account Registration

To use ResQ Pet, you must create an account. When registering, you agree to:

Provide accurate, current, and complete information about yourself
Maintain and promptly update your account information to keep it accurate
Keep your account credentials secure and not share access with others
Accept responsibility for all activities that occur under your account
Maintain only one account per person

We offer account creation through social authentication providers including Google, Apple, and Facebook. By using these services, you also agree to their respective terms of service.

4. Subscription Plans and Billing

ResQ Pet offers the following subscription plans:

Free Plan: Register up to 1 pet at no cost
Monthly Plan: $0.99 per month for unlimited pets
Annual Plan: $3.99 per year for unlimited pets (best value)

Billing Terms:

Paid subscriptions automatically renew unless cancelled before the renewal date
You may cancel your subscription at any time through your account settings
Refunds: If you cancel a paid subscription mid-cycle, you will receive a prorated refund for the unused portion of your subscription period
Payment is processed securely through Stripe. By subscribing, you also agree to Stripe's terms

5. User Content and Conduct

Your Content: You retain ownership of all content you submit to ResQ Pet, including pet photos, names, and medical information. By uploading content, you grant ResQ Pet a limited license to use this content solely for the purpose of providing our service, including:

Displaying your pet's profile when their tag is scanned
Sending pet recovery alerts to you and your emergency contacts
Showing your pet information in your account dashboard

We will not use your pet photos or personal information for marketing or promotional purposes without your separate, express consent.

Prohibited Conduct: You agree not to:

Submit false, misleading, or fraudulent information about pets or ownership
Use the service to harass, abuse, or harm others
Attempt to claim or register pets that do not belong to you
Use the service for any unlawful purpose or in violation of these Terms
Interfere with or disrupt the service or its infrastructure

6. QR Tags and Physical Products

ResQ Pet QR tags are sold through our authorized manufacturer partners. Regarding physical products:

Physical tag warranties and returns are handled by the manufacturer from whom you purchased the tag
ResQ Pet is not responsible for defects in physical products
Each QR tag is designed to be associated with one pet at a time
You may reassign a tag to a different pet through your account dashboard
Lost or damaged tags should be replaced by purchasing a new tag from our partners

7. SMS Service Terms

By opting into SMS notifications, you agree to the following:

You consent to receive automated text messages from ResQ Pet regarding pet recovery alerts
Message frequency varies based on pet scan activity in your area
Standard message and data rates may apply based on your mobile carrier plan
You can opt out at any time by replying STOP to any message
For help, reply HELP to any message or email support@resqpet.us
Carriers are not liable for delayed or undelivered messages

SMS consent is not required to use ResQ Pet. You may opt for email-only notifications in your account settings.

8. Intellectual Property

ResQ Pet and its licensors own all rights, title, and interest in:

The ResQ Pet service, website, mobile applications, and technology
The ResQ Pet name, logo, and all related trademarks and branding
All software, code, designs, and documentation

You are granted a limited, non-exclusive, non-transferable license to use the service for personal, non-commercial purposes while you maintain an active account. You may not:

Copy, modify, or create derivative works of the service
Reverse engineer, decompile, or attempt to extract source code
Scrape, crawl, or use automated tools to access the service
Sublicense, sell, or transfer your access to others

9. Disclaimers

THE RESQ PET SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We specifically disclaim:

No Guarantee of Recovery: While we strive to help reunite lost pets with their owners, we cannot guarantee that a lost pet will be found or returned
Third-Party Actions: We are not responsible for the actions of individuals who scan your pet's tag or respond to alerts
Service Availability: We do not guarantee uninterrupted or error-free service
No Medical Advice: Information stored in pet profiles is for informational purposes only and does not constitute veterinary advice

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

ResQ Pet's total liability to you for any claims arising from or related to the service shall not exceed the total amount you paid to ResQ Pet in the twelve (12) months preceding the claim
ResQ Pet shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of pets, emotional distress, or loss of data
Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages. If these laws apply to you, some or all of the above limitations may not apply

11. Indemnification

You agree to indemnify, defend, and hold harmless ResQ Pet, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to the service.

12. Dispute Resolution and Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Informal Resolution: Before initiating arbitration, you agree to contact us at support@resqpet.us and attempt to resolve any dispute informally for at least thirty (30) days.

Binding Arbitration: If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or the service shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules.

Arbitration may be conducted by telephone, through written submissions, or in person in your state of residence
The arbitrator's decision will be final and binding
Each party shall bear its own attorneys' fees and costs
Judgment on the arbitration award may be entered in any court of competent jurisdiction

Small Claims Exception: Either party may bring an individual action in small claims court if the claim qualifies.

CLASS ACTION WAIVER: YOU AND RESQ PET AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

13. Termination

Termination by You: You may cancel your account at any time through your account settings or by contacting us. If you have a paid subscription, you will receive a prorated refund for any unused portion.

Termination by ResQ Pet: We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion with notice.

Effect of Termination: Upon termination, your right to use the service will immediately cease. Your pet profiles will be deactivated, and QR tags will no longer display pet information. We will retain certain data as described in our Privacy Policy.

14. Changes to These Terms

We may update these Terms from time to time. For material changes, we will provide at least thirty (30) days' notice via email or through the service before the changes take effect.

Your continued use of ResQ Pet after any changes indicates your acceptance of the updated Terms. The current version will always be available at resqpet.us/terms.

15. General Provisions

Governing Law: These Terms shall be governed by the laws of the State of Texas, without regard to conflict of law principles
Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and ResQ Pet
No Waiver: Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision
Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction
